Please read these Terms of Service (“Terms”) carefully before using Dam Nation Collective, LLC's (“we,” “us,” or “our”) website and services. By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

Dam Nation Collective provides a platform for people (fans, supporters, members, etc.) to make contributions through Stripe, track their contributions, participate in campaigns, and earn prizes, and other exclusive benefits (“Services”). Our Services are provided “as is” and “as available” without any warranties, either express or implied.

2. Financial Disclaimers

• All contributions are final and non-refundable unless required by law.
• All contributions are not tax-deductible.
• We are not responsible for any loss of funds due to technical issues, payment processing errors, or any other circumstances.
• Stripe handles all payment processing. We do not store credit card information on our servers.
• By using our Services, you explicitly consent to sharing your personal and financial data with Dam Nation Collective, Stripe, and other necessary third-party service providers.
• We are not responsible for any financial data loss, whether caused by technical issues, security breaches, or other circumstances.
• Prizes, rewards, and other exclusive benefits are subject to availability and may be modified, reduced, or discontinued at any time without notice or compensation.

3. User Responsibilities

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You agree not to use the Services for any illegal or unauthorized purpose.
• You must be at least 18 years old to use our Services.
• By creating an account, you agree that your profile will be publicly visible, including your name and contribution history on our Hall of Fame. You can modify your privacy settings at any time through your account settings page.
• Your account will be automatically enrolled to earn rewards for qualifying contributions. You may opt out of the rewards program at any time through your account settings page.

4. Potential Risks and Limitations

• Service interruptions may occur due to maintenance, technical issues, or factors beyond our control.
• Campaign tracking data may be delayed or occasionally inaccurate due to technical limitations.
• Prize and other exclusive benefit fulfillment may be delayed or modified based on availability and shipping constraints.
• Account access may be temporarily suspended for security concerns or violation of these Terms.

5. Limitation of Liability

• To the maximum extent permitted by law, Dam Nation Collective shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• We are not liable for any loss or damage resulting from:
  • Unauthorized access to your account
  • Technical failures or errors in tracking systems
  • Delays in prize and other exclusive benefit fulfillment
  • Third-party payment processing issues
  • Loss of data or contributions

6. Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, any part of our Services with or without notice. This includes:

• Changes to contribution tracking methods
• Updates to campaign structures and rules
• Modifications to prize and other exclusive benefit systems
• Alterations to user interface and features

7. Termination

We reserve the right to terminate or suspend your account and access to Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

We reserve the right to refund and cancel any DAM Good Experience at our sole discretion, without notice, if we deem it necessary for the protection and wellbeing of Oregon State student-athletes, the university, or other participants. This includes but is not limited to situations involving safety concerns, inappropriate conduct, and/or other circumstances.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Oregon, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Services following any changes indicates your acceptance of such changes.
